Terms of Use
These Terms of Use ("Terms") govern your access to and use of cryptologyapps.com (the "Site"), operated by Cryptology LLC ("Cryptology", "we", "us", or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
These Terms apply to the Site only. Each mobile application we publish has its own Terms of Service, which govern your use of that app. For Griddle, see the Griddle Terms of Service. The Site's data handling is described in the Site Privacy Policy, which is incorporated by reference into these Terms.
1. Eligibility and Use of the Site
The Site is intended for visitors aged 13 or older. By using the Site, you represent that you meet this requirement. If you are visiting on behalf of an organization, you represent that you have the authority to do so.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and view the Site for personal and non-commercial informational purposes. All other rights are reserved.
The Site exists primarily as a marketing surface for our services and as a host for legal documentation associated with our mobile applications. The Site does not offer accounts, transactions, or interactive services beyond plain content.
2. Restrictions
You agree not to, and not to permit any third party to:
- Copy, reproduce, distribute, modify, or create derivative works from the Site or its content, except as expressly permitted by these Terms or applicable law
- Use automated systems (bots, scrapers, crawlers, or similar) to access, monitor, or extract data from the Site at scale
- Reverse engineer, decompile, or attempt to derive source code or underlying ideas from the Site
- Frame, mirror, or otherwise embed the Site or its content on any other website without our prior written consent
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices
- Interfere with, disrupt, or attempt to gain unauthorized access to the Site, our servers, or any networks connected to the Site
- Use the Site in any manner that violates applicable law, including export control, sanctions, or anti-money-laundering laws
- Use the Site to engage in or facilitate any unlawful, fraudulent, harassing, or abusive activity
3. Intellectual Property
The Site and all content within it, including software code, designs, graphics, text, and the compilation thereof, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.
"Cryptology" and any logos, taglines, or product names used on the Site are our trademarks or service marks. You may not use them without our prior written consent.
4. Mobile Applications
The Site links to mobile applications we publish. Use of any application is governed by that application's own Terms of Service and Privacy Policy, available in the per-app section of the Site (e.g., the Griddle Terms of Service and the Griddle Privacy Policy). Nothing in these Terms of Use grants any rights with respect to those applications.
5. Third-Party Links
The Site may contain links to third-party websites or services. We do not control, and are not responsible for, the content, privacy practices, or availability of those external resources. Your interactions with any third party are solely between you and that party.
6. Disclaimer of Warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF INFORMATION.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (A) THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) DEFECTS WILL BE CORRECTED; (C) THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) INFORMATION ON THE SITE IS CURRENT, ACCURATE, OR COMPLETE.
We may change, suspend, or discontinue any aspect of the Site at any time without notice. Some jurisdictions do not allow the exclusion of certain warranties; in such jurisdictions, some of the above exclusions may not apply to you, and you may have additional rights.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OR OUR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE LIMITATIONS IN THIS SECTION APPLY WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
NOTHING IN THIS SECTION LIMITS OR EXCLUDES LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FRAUD OR FRAUDULENT MISREPRESENTATION, OR ANY OTHER LIABILITY THAT MANDATORY CONSUMER PROTECTION LAWS IN YOUR JURISDICTION DO NOT PERMIT TO BE EXCLUDED. IF YOU ARE A CONSUMER IN THE EUROPEAN ECONOMIC AREA, THE UNITED KINGDOM, OR ANOTHER JURISDICTION WITH MANDATORY CONSUMER PROTECTIONS, NOTHING IN THESE TERMS REDUCES YOUR STATUTORY RIGHTS.
8. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless us, our affiliates, and our respective officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use or misuse of the Site; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) your violation of any applicable law or regulation.
9. Termination of Access
We may suspend or terminate your access to the Site at any time, with or without cause and with or without notice. Upon termination, your right to access the Site ceases immediately. Sections 3, 6, 7, 8, 10, 11, 13, and 15 of these Terms will survive termination.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
If you are a consumer located in the European Economic Area, the United Kingdom, or any other jurisdiction whose law mandates that consumer disputes be governed by local law, the foregoing will not deprive you of the protection of mandatory local law.
11. Dispute Resolution
Before initiating any formal proceeding, you agree to first contact us at contact@cryptologyapps.com to attempt to resolve the dispute informally. If the dispute is not resolved within thirty (30) days, either party may pursue formal resolution as described below.
Any dispute arising out of or relating to these Terms or your use of the Site that cannot be resolved informally will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and the parties consent to the personal jurisdiction of those courts. Nothing in this section limits your rights to bring a claim in your local courts where such rights are required by applicable law.
Disputes that arise out of or relate to your use of one of our mobile applications, rather than the Site, are governed by that application's own dispute resolution provisions.
12. Changes to These Terms
We may modify these Terms from time to time. The "Last Updated" date at the top of these Terms reflects the most recent revision. Material changes take effect on the new effective date as posted; your continued use of the Site after the effective date constitutes acceptance.
13. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, that provision will be severed from these Terms, and the remaining provisions will continue in full force and effect. The parties will negotiate in good faith to replace the severed provision with a valid and enforceable provision that achieves, to the extent possible, the original economic and legal intent.
14. Entire Agreement
These Terms, together with the Site Privacy Policy, constitute the entire agreement between you and us regarding the Site and supersede all prior or contemporaneous communications regarding the Site, whether electronic, oral, or written.
15. Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.
16. Assignment
You may not assign or transfer these Terms or any of your rights or obligations hereunder without our prior written consent. We may assign these Terms at any time without notice to you. Any attempted assignment in violation of this section is void.
17. Force Majeure
We will not be liable for any failure or delay in performance under these Terms caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government actions, labor disputes, pandemics, internet or telecommunications failures, or third-party service outages.
18. Electronic Communications
By using the Site, you consent to receive communications from us electronically, and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
19. Accessibility
We strive to make the Site accessible to users with disabilities, including by following modern web accessibility guidelines. If you encounter an accessibility barrier on the Site, please contact us at contact@cryptologyapps.com with a description of the barrier so we can address it.
